1. Acceptance of Terms
By accessing or using PulseUp ("the Service"), operated by Osny Netto, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
PulseUp provides uptime monitoring, alerting, and public status page services for websites, APIs, and other internet-accessible endpoints. The Service is provided on a subscription basis with free and paid tiers.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account.
4. Acceptable Use
You agree not to:
- Use the Service to monitor endpoints you do not own or have permission to monitor
- Attempt to overload, disrupt, or gain unauthorized access to the Service or its infrastructure
- Use the Service for any unlawful purpose
- Resell or redistribute the Service without prior written consent
- Interfere with other users' use of the Service
5. Payment and Billing
Paid plans are billed monthly or annually as selected. All fees are non-refundable except as required by law. We may change pricing with 30 days' notice. Payment is processed securely via Stripe.
6. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We are not liable for any damages resulting from service downtime, delayed alerts, or monitoring failures.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You retain ownership of your data. We may use aggregated, anonymized data to improve the Service.
8. Intellectual Property
The Service, including its design, code, and branding, is owned by PulseUp. You may not copy, modify, or reverse-engineer any part of the Service.
9. Termination
You may cancel your account at any time. We may suspend or terminate your account if you violate these terms. Upon termination, your data will be deleted according to our retention policy.
10. Limitation of Liability
To the maximum extent permitted by law, PulseUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service.
11. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. We will notify you of material changes via email or through the Service.
